Legal
These Creator Terms govern the use of Audium's creator and publishing services by artists, musicians, producers, labels, and other rights holders ("Creator", "you", or "your"). By creating an Audium Creator account, uploading content, or submitting a release to Audium, you agree to these Creator Terms and the applicable Audium Terms of Service and Privacy Policy.
Before you publish
You keep ownership of your music.
By publishing a release, you confirm that you own or have obtained the necessary rights and permissions to make it available on Audium. Audium receives the permissions necessary to host, process, stream, display, and operate the service with your content. This does not transfer ownership of your music to Audium.
You are responsible for any rights or contractual restrictions affecting your release.
I confirm that I have the necessary rights and authorization to publish this release on Audium.
Audium is a music listening and publishing platform operated by Arinten.
Audium allows creators to publish music directly to Audium listeners without requiring a traditional record label.
Audium is not currently a general-purpose music distributor.
Uploading music to Audium does not automatically distribute that music to Spotify, Apple Music, YouTube Music, Amazon Music, or other third-party streaming services.
You may continue to use a separate distributor for those services.
Audium's current creator platform is focused on:
Additional creator services may be introduced in the future.
You retain ownership of your music and other intellectual property that you upload to Audium.
Uploading content to Audium does not transfer ownership of your sound recordings, musical compositions, lyrics, artwork, artist name, brand, trademarks, or other intellectual property to Audium or Arinten.
You are responsible for determining what rights you own and what permissions you have.
When you upload or submit content, you grant Audium a non-exclusive, worldwide, royalty-free license to host, store, reproduce, encode, process, technically modify, transmit, publicly perform, display, communicate, distribute, and make that content available through Audium.
This license exists only to the extent reasonably necessary to operate Audium, store your files, deliver music to listeners, display artwork and metadata, create previews and playback functionality, maintain backups, provide creator analytics, promote your release within Audium, and operate security, moderation and abuse-prevention systems.
This license does not transfer ownership of your content to Audium.
Unless separately agreed with you, Audium does not receive an exclusive right to your music.
Audium does not intend to use creator-uploaded music to train generative AI models.
Audium does not intend to sell creator-uploaded music to third parties for generative AI training.
The license granted to Audium is intended to allow Audium to operate its music platform and is not a general-purpose license to exploit your music for unrelated purposes.
If Audium proposes a materially different use of creator content that requires additional rights or consent, Audium may request additional permission where appropriate.
You must have all rights, licenses, permissions, consents, and authorizations necessary to upload and make your content available on Audium.
This includes, where applicable: master recording rights, composition rights, publishing rights, sample clearances, producer permissions, featured artist permissions, label permissions, artwork rights, performance rights, and any other rights required for the release.
You must not upload music merely because you possess a copy of the file. Possessing a recording does not necessarily mean you have the right to publish it.
Audium does not require creators to be unsigned.
You may have agreements with labels, distributors, publishers, managers, or other organizations. However, you are responsible for checking those agreements before uploading a release.
If a contract grants another party exclusive rights that prevent you from making the recording available on Audium, you must not upload it unless you have appropriate authorization.
Audium does not determine the meaning of your private contracts.
When submitting a release, you may be required to confirm: "I confirm that I own or have obtained the necessary rights and permissions to make this recording available on Audium. I understand that I am responsible for the accuracy of this declaration and for any rights-related claims arising from my upload."
Submitting this confirmation does not eliminate your legal responsibility for the accuracy of your claim.
Audium may introduce functionality allowing creators to identify featured artists, collaborators, producers, or other contributors.
You are responsible for ensuring that the individuals identified in a release have been properly represented and that you have the necessary permissions to use their names and contributions.
Creators may organize music into singles, albums, EPs, or other supported release formats.
Creators are responsible for ensuring that the metadata associated with their releases is accurate.
Audium may establish technical requirements for audio formats, artwork, file size, metadata, release titles, track ordering, and explicit-content labeling. These requirements may change as the service develops.
You are responsible for the accuracy of information submitted with your release, including track title, artist name, album title, genre, release information, explicit-content status, artwork, and contributor information.
You must not intentionally submit misleading metadata designed to impersonate another artist or manipulate discovery.
Audium does not automatically prohibit music simply because AI tools were involved in its creation. However, creators remain responsible for having the necessary rights to their submitted material.
Audium may introduce disclosure categories such as human-created, AI-assisted, or AI-generated.
Audium may also use moderation, reporting, technical analysis, and other quality-control systems to identify potentially problematic or mass-generated content.
No automated AI detection system should be considered perfectly accurate. Audium may review disputed cases and may take action where content violates these Terms or applicable policies.
You may not upload content that: you do not have permission to distribute; infringes copyright or trademarks; violates publicity or privacy rights; contains unauthorized samples; impersonates another creator; uses misleading metadata; contains malicious code or harmful files; is unlawful or fraudulent; is intended to manipulate Audium's systems; attempts to artificially inflate plays or analytics; or violates Audium's applicable content policies.
Audium may remove or restrict content that violates these rules.
Creators must not artificially generate plays, lookups, engagement, or other activity. This includes bots, automated playback, click farms, purchased fake streams, scripted traffic, fraudulent accounts, coordinated manipulation, and other attempts to artificially inflate performance.
Artificial activity may be removed from analytics. Audium may suspend or terminate accounts involved in manipulation.
Audium currently provides basic first-party analytics, which may include plays and lookups.
Analytics represent activity recorded by Audium. Analytics are not guaranteed to be perfectly accurate and may be adjusted to account for fraud, duplicate events, technical errors, bot activity, or system corrections.
Audium does not currently provide Spotify, Apple Music, YouTube, or other DSP analytics through the creator portal.
Creator monetization is not currently a guaranteed V1 feature.
Audium may introduce creator monetization in the future, potentially including advertising revenue sharing, creator promotional programs, sponsorship opportunities, paid promotional placements, or other creator revenue programs.
Nothing in these Creator Terms guarantees that you will receive revenue from your music.
If Audium introduces a creator monetization program, the applicable program terms, eligibility requirements, revenue calculations, payment terms, taxes, thresholds, and other conditions will be communicated separately.
Audium may allow eligible creators to participate in sponsorship or promotional programs.
Sponsored content, sponsored tracks, sponsored placements, or other paid promotional content will be identified as sponsorship or advertising where appropriate.
Audium will not intentionally present paid advertising as independent editorial content.
Audium may recommend music based on listening behavior, discovery systems, editorial decisions, popularity, relevance, genre, personalization, and other platform signals.
A recommendation does not automatically mean the creator paid for that placement.
Where a creator or advertiser has paid for placement, the placement will be treated as sponsored/promotional content and identified accordingly.
Audium may provide creators with opportunities to promote their own music, such as sponsored placement opportunities allowing a creator to promote a release to listeners.
Availability, frequency, eligibility, pricing, placement, and limits may vary. Participation does not guarantee a specific number of impressions, plays, listeners, or conversions.
Audium may designate an initial group of creators as founding or early creators.
The first group of creators may receive special benefits including promotional opportunities, special account status, platform recognition, or other benefits communicated to eligible creators.
Founding status does not guarantee revenue, specific play counts, permanent algorithmic promotion, guaranteed placement, or guaranteed sponsorship results.
Audium may publish separate terms for specific founding-creator benefits.
Audium may display advertising to support operation of the platform, including display advertising, sponsored music, sponsored recommendations, promotional notifications, audio advertising, and other advertising formats.
Audium may use advertising that is designed to minimize disruption to music listening. Paid promotional content will be identified appropriately.
Creators participating in sponsorships or promotional campaigns must not make deceptive or unsupported claims about products, services, or businesses.
Where a creator has a material financial or other relationship with a brand, that relationship should be disclosed where required by applicable law and platform rules.
If you no longer want a release available on Audium, you may request its removal through the creator portal or by contacting support-audium@arinten.com.
Audium may also remove content when required because of copyright complaints, legal requirements, contractual disputes, policy violations, fraud, security concerns, abuse, or other legitimate operational reasons.
If you believe content available on Audium infringes your copyright, contact support-audium@arinten.com with sufficient information for Audium to identify the allegedly infringing work, your relationship to the rights, your contact information, and the basis of your claim.
Audium may request additional information before taking action. Where applicable, Audium may follow legally required copyright notice-and-takedown procedures.
Audium is not a substitute for a court, arbitrator, label, publisher, distributor, or rights-management organization.
If two parties dispute ownership or authorization of a recording, Audium may temporarily restrict the content while the matter is investigated and may request documentation from the parties involved.
You are responsible for maintaining the security of your creator account. You must not share your credentials, allow unauthorized people to access your account, attempt to access another creator's account, circumvent authentication, or exploit vulnerabilities.
Report suspected security issues to support-audium@arinten.com.
You must not attempt to interfere with Audium's infrastructure or services, including unauthorized API access, scraping where prohibited, reverse engineering for malicious purposes, denial-of-service attacks, credential attacks, automated abuse, circumventing upload restrictions, exploiting analytics systems, or attempting to manipulate recommendations.
Audium may suspend or terminate creator accounts where reasonably necessary to enforce these Terms, prevent fraud, protect users, protect rights holders, address copyright complaints, prevent security threats, comply with law, or protect Audium's infrastructure.
Where appropriate, Audium may provide notice and an opportunity to resolve the issue. Serious violations may result in immediate restriction or termination.
If your account is suspended or terminated, Audium may remove your content from public availability.
Certain copies may remain temporarily in backups, caches, logs, or systems necessary for security, legal compliance, or technical operation.
Termination does not eliminate rights or obligations that by their nature should survive termination.
Uploading music to Audium does not guarantee plays, listeners, recommendations, search placement, editorial placement, sponsorship, revenue, followers, playlist placement, or viral growth.
Audium does not promise that a release will become popular.
Audium may introduce monetization features, but creators should not upload music with the assumption that Audium currently guarantees payment.
Any future monetization program will have its own terms.
Audium is an evolving platform. Features may be added, removed, modified, replaced, limited, or temporarily unavailable.
Audium may change creator tools, analytics, promotional programs, and advertising formats as the platform develops.
Audium's creator beta is an early-stage testing program. Beta functionality may contain bugs or limitations.
Creators participating in the beta understand that features may change, analytics may change, upload workflows may change, content may temporarily become unavailable, and some functionality may not be production-ready.
Creators should retain their own copies of uploaded material.
Creators can contact Audium at support-audium@arinten.com regarding upload problems, account issues, metadata corrections, takedown requests, rights questions, copyright complaints, sponsorship questions, creator portal issues, and other creator-related matters.
Audium will make reasonable efforts to respond, but does not guarantee a specific response time unless separately stated.
Audium may rely on third-party infrastructure and services to operate the platform, including hosting, storage, authentication, analytics, payment, advertising, and other infrastructure providers. Third-party service availability may affect Audium.
Audium is provided on an evolving and, where applicable, beta basis. To the maximum extent permitted by applicable law, Audium does not guarantee uninterrupted or error-free operation.
Audium is not responsible for losses resulting from unauthorized creator uploads, creator contractual disputes, inaccurate rights declarations, third-party service failures, creator metadata errors, unauthorized use of creator accounts, or events outside Audium's reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Audium, Arinten, and their respective personnel from claims, losses, liabilities, damages, and expenses arising from your violation of these Terms, your uploaded content, your failure to obtain necessary rights, your breach of a third-party agreement, your infringement of another person's rights, your misuse of the platform, or your fraudulent or unlawful activity.
This provision should be reviewed by legal counsel before publication.
Audium's handling of personal information is governed by its Privacy Policy.
Creators should not upload personal information belonging to another person unless they have a lawful basis and appropriate permission to do so.
Creators must meet the minimum age requirements applicable to Audium and their jurisdiction.
If Audium permits younger users under applicable law, additional protections may apply.
⚠ This section requires review by legal counsel before publication.
The governing law, dispute-resolution mechanism, jurisdiction, arbitration provisions, and other legal framework applicable to these Creator Terms should be specified based on the legal entity operating Audium and the jurisdictions in which it operates.
Have counsel insert the actual legal entity, registered address, governing law, jurisdiction, and dispute mechanism before publication.
Audium may update these Creator Terms as the platform develops.
Material changes may be communicated through the platform or other appropriate means.
Your continued use of Audium after updated terms become effective constitutes acceptance where permitted by applicable law.
